CONTRACT
Before your session, a contract will be signed. My contract protects both parties. The contract will typically be signed at your consultation. The contract will be signed by all adult parties to be photographed and/or the parent/guardian of a minor child who is to be photographed. Contract terms are not negotiable.
MODEL RELEASE
Part of my contract includes a model release. This means that images may be used for advertising or portfolio purposes. However, if for personal or legal reasons you may not want photos of you or your children used online, the model release may be amended slightly. Please also note that only the custodial parent has the ability to sign a contract/model release on behalf of a minor child.
COPYRIGHT
As per Federal Copyright Law, the photographer inherently owns copyright (intellectual property) to all images. By commissioning my services, you receive rights for personal use and display of your images, but certain limitations are in place for how they may be used.
EDITING/RETOUCHING
Standard editing and retouching is included (lighting and color correction, skin smoothing, and standard sharpening). Extra-ordinary editing or retouching will require an additional $25 fee per image to be paid before editing can be completed.
SESSION FEES & RETAINERS
A non-refundable retainer fee is required to book your session. The remaining balance is due at the time of the photo session. The retainer is to hold the session appointment only and is not refundable in the case of a cancellation by the client. A retainer may be applied towards one reschedule that takes place within 14 days of the original session date in case of illness/weather. If I have to cancel the session (due to emergency) and you do not wish to reschedule, the session retainer fee will be refunded in full.
TRAVEL & USAGE FEES
A travel fee of $0.50 per mile will apply for desired locations outside of a 60 mile round trip distance from Hobbs, NM. If a desired location requires a usage fee or permit, this will be the responsibility of the client.
ACCEPTED FORMS OF PAYMENT
Cash, check or credit card are accepted. There is a $25 return check fee for insufficient funds.
